STAND UP FOR TRANS RIGHTS ✊ OPPOSE THE EHRC.

Soo, if you’ve been living under a rock & you’re wondering wtf is the EHRC code of practice… keep reading babes.

Last April, the UK Supreme Court redefined ‘s*x’, ‘man’ and ‘woman’ in the Equality Act as s*x assigned at birth only.

Last week, the Equality and Human Rights Commission (EHRC) released guidance on how the Supreme Court ruling can be implemented in practice.

Here’s what this guidance means for trans people:

• Trans people are advised to use facilities matching their birth s*x where single-s*x exemptions apply - this could be anything from toilets, changing rooms, gyms, refuges, hostels and more - regardless of whether they hold a Gender Recognition Certificate.

• Whilst the guidance says it is ‘unlikely to be practical or appropriate to challenge people in ordinary toilet settings’ and no one is legally required to police bathrooms… we already know gender policing happens in single-s*x spaces and expect this to increase after this is passed - further endangering trans people and stopping their participation in daily life

• Venues are not obligated however to have gendered spaces - going fully gender neutral is still an option. Gender neutral toilets, changing rooms etc. are perfectly fine.

• The guidance does not offer clear ways for gendered services who wish to remain trans inclusive

What won’t change:

• Gender reassignment is still a protected characteristic and trans people are still legally protected from harassment and harm.

This guidance is not yet law. MPs and peers have until June 30 to challenge it - if they don’t - it becomes law automatically.
